Georgia's constitution states, all government, of right, originates with the people, is founded upon their will only, and is instituted for the good of the whole. Public officers are the trustees and servants of the people and are at all times amenable to them."
What should an empowered voter know?
There are three Branches of Government: Executive, Legislative, and Judicial.
Rule of Law-Both government and the governed should be subject to the law. Separation of Powers-Legislative, Executive, and Judicial powers should be exercised by different institutions in order to maintain the limitations placed upon them.
Checks and Balances-the powers given to the different branches of government should be balanced, that is roughly equal, so that no branch can completely dominate the others. Branches of government are also given powers to check the power of other branches.
Legislative Branch (Congress):
Checks and Balances with the Executive Branch, the Congress:
- May disapprove appointments
- May disapprove treaties
- May impeach president
- May override a veto
Checks and Balances of Congress with the Judicial Branch:
- May propose Constitutional amendments to override decisions
- May disapprove presidential appointments to Supreme Court
- May impeach Supreme Court judges
The Executive Branch -The President:
- Administers the Laws
- Appoints ambassadors, judges, and other officials
- Negotiates treaties
- Conducts foreign policy
- Proposes laws
- Commands armed forces
Checks and Balances for Executive Branch:
- May veto bills from Congress
- Appoints Judges to Judicial Branch
The Judicial Branch (Supreme Court):
- Interprets the laws
- Reviews Court decisions
Its checks and balances to Congress and the Executive Branch:
- May declare laws unconstitutional
- May declare executive actions unconstitutional
